1. Agreement to Terms
By accessing or using any YelloPost website or service, you agree to be bound by these Terms of Service. If you do not agree, please do not use our services. These terms apply to all visitors, clients, and users of yellopost.com, yelloscan.com, adawebpro.com, and related properties.
2. Services Provided
YelloPost Advertising Services provides digital marketing and advertising services including but not limited to: website design and development, search engine optimization (SEO), search engine marketing (SEM), social media advertising and management, email marketing, streaming TV advertising, digital out-of-home advertising, reputation management, ADA compliance services, and AI-powered content creation.
Service terms, deliverables, and pricing for individual clients are governed by a separate client agreement or statement of work.
3. No Contracts Policy
YelloPost operates on a month-to-month basis for most services. There are no long-term contracts required. Either party may terminate services with written notice as specified in your individual client agreement. Fees for services already rendered are non-refundable.
4. Free Audit & YelloScan
The free AI website audit ("YelloScan") is provided at no charge as a demonstration of our capabilities. Results are informational only and do not constitute a guarantee of outcomes. By requesting a free audit, you agree to be contacted by a YelloPost representative regarding your results and our services. You may opt out of further communications at any time.
5. Intellectual Property
All content on YelloPost websites — including text, graphics, logos, and code — is the property of YelloPost Advertising Services and protected by applicable copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our express written permission.
Work product created for clients (websites, ad creative, content) becomes the property of the client upon full payment, unless otherwise specified in the client agreement.
6. Client Responsibilities
Clients are responsible for:
- Providing accurate business information and access credentials required for campaign management
- Reviewing and approving deliverables in a timely manner
- Ensuring all content provided to YelloPost does not infringe on third-party rights
- Timely payment of all invoices per agreed terms
- Notifying YelloPost of any changes that may affect campaign performance
7. Advertising Platform Terms
Our services involve third-party advertising platforms including Google, Meta, Microsoft, and others. Your use of campaigns managed on these platforms is also subject to their respective terms of service and advertising policies. YelloPost is not responsible for policy changes, account suspensions, or other actions taken by third-party platforms.
8. Results Disclaimer
Digital marketing results vary based on industry, competition, budget, market conditions, and many other factors outside our control. YelloPost does not guarantee specific rankings, traffic levels, lead volumes, or revenue outcomes. We commit to applying our expertise and best practices to every campaign.
9. Limitation of Liability
To the maximum extent permitted by law, YelloPost shall not be liable for any indirect, incidental, special, or consequential damages arising from use of our services. Our total liability to any client shall not exceed the total fees paid in the three months preceding the claim.
10. Indemnification
You agree to indemnify and hold harmless YelloPost, its founders, employees, and contractors from any claims, damages, or expenses arising from your use of our services, your violation of these terms, or your infringement of any third-party rights.
11. Privacy
Your use of our services is also governed by our Privacy Policy, which is incorporated into these terms by reference.
12. Governing Law
These terms are governed by the laws of the State of California, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Sacramento County, California.
13. Changes to Terms
We may update these terms at any time. Continued use of our services after changes are posted constitutes acceptance of the updated terms. We will notify active clients of material changes via email.
